Service Agreement

1. Parties

This Service Agreement is between Allwise Solutions Limited ("we", "us", "Service Provider", "the Company") and the Client ("you", "Client") who engages us to perform a Healthy Homes Standards compliance assessment of the property specified in the booking.

2. Scope of Services

We will provide the following services for the agreed fee:

  • On-site inspection of the property by a qualified assessor at the scheduled date and time.
  • Assessment against all five Healthy Homes Standards: Heating, Insulation, Ventilation, Moisture Ingress & Drainage, and Draught Stopping.
  • Smoke alarm inspection (visual only — functional testing not included).
  • Heating capacity calculation using the BRANZ ALF 3.5 methodology (Schedule 2, HH Standards Regulations 2019).
  • Moisture readings where accessible and agreed (using a calibrated moisture meter).
  • Digital compliance report delivered via our client portal and/or email, including:
    • Executive summary and overall health score.
    • Detailed findings for each standard with photographic evidence.
    • Heating calculation worksheet with full BRANZ formula breakdown.
    • Remediation action plan with estimated costs and contractor briefs.
    • Insulation breakdown (room-by-room where available).
    • Moisture readings table and smoke alarm schedule.
    • Inspector certification and compliance timeline.
  • Compliance expiry tracking and re-assessment reminders.

3. Exclusions

The following are not included in this service:

  • Electrical testing or certification of any kind.
  • Plumbing or gas-fitting inspection.
  • Structural, geotechnical, or weathertightness assessment.
  • Mould testing or indoor air quality assessment.
  • Asbestos identification or hazardous materials survey.
  • Pest or building infestation inspection.
  • Functional testing of smoke alarms or heating appliances.
  • Building consent or code compliance certification.
  • Remediation work or contractor coordination (unless separately engaged).

4. Client Obligations

To enable us to perform the assessment, you agree to:

  • Provide safe and unobstructed access to all areas of the property, including roof cavity and subfloor where applicable.
  • Ensure a responsible adult (owner or authorised representative) is present during the inspection.
  • Disclose any known hazards, defects, or building issues before the inspection.
  • Provide accurate property information (construction type, renovation history) to the best of your knowledge.
  • Secure pets and remove obstacles that may impede access to inspection areas.
  • Obtain necessary consent from tenants if the property is tenanted (minimum 48 hours' notice required under RTA s48).

5. Fees & Payment

  • The assessment fee is as quoted at the time of booking and confirmed in the booking confirmation.
  • All fees are in New Zealand Dollars (NZD) and inclusive of GST unless otherwise stated.
  • Payment is due within 7 days of invoice unless alternative terms are agreed in writing.
  • Reports will be released upon full payment.
  • Additional fees may apply for: re-inspections, travel beyond standard service area, urgent/rush reports.

6. Cancellation & Rescheduling

  • 48+ hours notice: Full refund or free reschedule.
  • 24–48 hours notice: 50% of fee retained, or reschedule with 50% credit.
  • Less than 24 hours or no-show: Full fee retained. Reschedule at full cost.
  • Weather/safety: If the inspector determines conditions are unsafe (e.g. severe weather, flooding), the assessment will be rescheduled at no cost.
  • Access refusal: If access is denied by a tenant or occupant despite notice being given, cancellation terms for the notice period apply.

7. Report Delivery

  • Reports are typically delivered within 3–5 business days of the inspection.
  • Reports are delivered digitally via email and/or the ALLWISE client portal.
  • A printed copy can be provided on request at additional cost.
  • The report is prepared for the Client named in the booking and is not to be relied upon by third parties without our written consent.

8. Limitation of Liability

  • Our liability is limited to the fee paid for the assessment.
  • We are not liable for defects not reasonably discoverable during a visual, non-invasive inspection.
  • We are not liable for conditions that change after the inspection date.
  • Nothing in this agreement limits liability that cannot be excluded under the Consumer Guarantees Act 1993.
  • AI-generated recommendations in the report must be reviewed and confirmed by the human inspector.

9. Insurance

The Company and its assessors maintain professional indemnity and public liability insurance appropriate for Healthy Homes inspection services. Certificates of currency are available on request.

10. Confidentiality & Data

  • Assessment data is stored securely and handled in accordance with our Privacy Policy and the NZ Privacy Act 2020.
  • Assessment results may be shared with the property owner/landlord where the Client is a tenant or property manager.
  • Anonymised data may be used for platform improvement and AI model training.
  • Reports may be used as evidence in Tenancy Tribunal proceedings.

11. Disputes

Any dispute arising from this agreement shall first be addressed through good-faith negotiation. If unresolved within 14 days, either party may refer the matter to mediation. This agreement is governed by New Zealand law.

12. Acceptance

By booking an assessment through the ALLWISE SOLUTIONS platform, you acknowledge that you have read, understood, and agree to be bound by this Service Agreement. A copy of this agreement will be provided with your booking confirmation.
